by commissioning bird_cult, you agree to the terms listed below

1 - the artist (referred to as "i" throughout this document) will not draw NSFW artwork for commission. this includes sexually explicit material, fetish material, or excessive violence/gore. suggestive artwork and mild violence are acceptable.i have limitations on complex machinery, vehicles, intricate weapons and the like. i'm happy to give it a try but i will be transparent and pivot if it's not working out.anything depicting self-harm, targeted harm, hateful speech, or insensitive content or imagery will not be done as commission work. i cultivate a supportive environment online, and if i am to depict sensitive topics i will only do so with my own nuance and understanding, never on the behalf or at the command of another individual.these are loose guidelines. i have a right to refuse or accept a commission for any reason with no questions asked. though i rarely reject comms and will probably give the client a reason if i do.2 - when paying for commissions, payment is taken in full up front. this is non-negotiable, except under the exclusive condition that the total amount for the commission surpasses $300 USD, in which case a payment plan may possibly be implemented at my discretion. the client may cancel a commission at any time, but by agreeing to pay the decided amount they acknowledge that it cannot be refunded in its entirety, and that if a cancellation is needed, only the portion of the funds that reflects the amount of work yet to be finished will be refunded.3 - if a piece is time-sensitive, please specify an exact date to set as the deadline PRIOR to payment. please commission accordingly so that the date of payment is NO LESS than one month prior to the deadline.4 - a character reference is required to begin work on a piece. the exception to this is character reference sheet commissions where we are collaborating on a new design. redesign commissions still require old reference unless it is a ground-up redesign.5 - all clients will receive work-in-progress shots throughout a piece to ensure they are satisfied with the direction of the piece. please let me know of any changes involving pose, composition, size, or character expression during the FIRST CHECK IN at the SKETCH STAGE. major changes beyond colors and patterns after the sketch stage may be reflected by additional compensation.6 - i may use any commissioned piece that i create for the following:- promotional purposes via any public or private channel or forum, whether it's general promotion or regarding my services
- posting onto my social media account(s)
- streaming the work as it is in progress for an audience to view my drawing process via discord, twitch, or other chat or stream servicesi may NOT directly use (i.e. merchandise) a commission piece for profit beyond initial payment.
the client also may NOT use a piece created by myself in order to generate profit in any fashion, or claim it as their own work. the client may post the work to any social media platform, if they credit my social handle on that platform or another platform if not applicable. failure to abide by this rule will result in a good faith dispute and an attempt to reconcile. failure to reach a solution will result in the client being barred from future collaboration.7 - i do not consent to the use of my commission work in any content related to artificial intelligence including but not limited to: training AI algorithms, the promotion of AI programs or any content relating to them, and the generation of images with my name or any of my social media handles as part of the prompt. failure to abide by this rule will result in action to remove violating content and, whether successful or unsuccessful, a permanent restriction on future business with the client.8 - i also do not consent to any of my work being related in any fashion to the production or promotion of non-fungible tokens (NFTs). failure to abide by this rule will result in action to remove violating content and, whether successful or unsuccessful, a permanent restriction on future business with the client.i'm ready. take me to the
